    Many clients of Júramelo.es ask us to provide sworn translations of documents to be presented in court, whether for reasons related to international business, marriages, divorces, the purchase of property or the execution of wills, among other cases.

    Thus, we have decided to address this issue since it is not simple and is usually a source of doubts among our clients. It is usually the lawyers who are in charge of presenting in court the foreign documents that normally have to accompany a lawsuit. When the matter becomes litigation, the problem of how to handle evidentiary documentation in different languages then arises.

    A sworn translation differs from a normal or simple translation in that it offers some guarantees regarding the accuracy of its content. In the same way that a notarized document is guaranteed by the signature and seal of the notary, in the case of this type of translation, the sworn translator accompanies the translation with his official seal, his signature and a brief description. In this way, the authorities can be sure that no information has been added or deleted during the translation process.

    On the other hand, it must be taken into account that not all translators are sworn translators, so you should use a professional who has been appointed as a Sworn Translator/Interpreter by the Spanish Ministry of Foreign Affairs and Cooperation, as all Juramelo.es translators are.

    How do I know if I need a sworn or normal translation?
    Generally, a sworn translation is done for documents to be submitted to official organizations that require it. However, there are cases in which it is not absolutely necessary. The agency receiving the translation is usually the one that determines whether or not it should be sworn or not. Another important aspect is to know if the document needs to bear the Hague Apostille before translating it.

    When in doubt, what do I do?

    If you are not sure whether or not you need a sworn translation, ask the agency where you must carry out the formalities. Even so, it never hurts to have one just in case you need it.
